Recent Laser Lead Extraction Lawsuit

After a two-week trial, an Illinois jury handed down a unanimous verdict recently finding a hospital guilty of medial malpractice. The lawsuit was filed after a 64-year-old man went through a laser extraction program to remove a pacemaker and later died in a hospital Cath Lab where the heart and blood vessels were perforated by the laser. The complaint alleged that the patient was the victim of a poorly prepared staff that not only perforated his heart but also was unable to respond to the injury in a timely manner. The family will now receive over $2 million as compensation for their loss.

Laser Lead Extraction

A laser lead extraction is the laser procedure used to take out a pacemaker or defibrillator from inside the heart. A cardiac pacemaker is a device that is implanted into cardiac patients to normalize their heart rate or rhythm. Pacemakers use leads, a wire that runs from a pacemaker or implantable defibrillator into the heart’s chambers. During the pacemaker removal process, a doctor uses a laser to burn through scar tissue encapsulating the lead wires. This requires the laser to go through the major vein leading to the heart and into the chamber of the heart where the lead is attached. Any error during the procedure can lead to devastating, even fatal consequences for the patient.

Medical Malpractice for Laser Lead Extraction Injuries

A claim for medical malpractice in the surgical removal of leads for pacemakers and defibrillators is typically quite complex. Medical malpractice occurs when a doctor or other medical professional breaches the standard of care to diagnose and/or treat the patient with the level of skill, knowledge and care ordinarily required of members in that medical professional’s specialty. It is not enough, however, to prove that the medical professional violated the standard of care. As the injured patient, you must also prove that the violation of the standard of care was a direct and proximate cause of your injury.
